Terms of Service & Enterprise SLA
This definitive Master Services Agreement governs commercial access to the BrandEye platform, real-time public data ingestion streams, 99.9% uptime commitments, multi-tenant customer isolation, and intellectual property rights.
1. Platform Scope & Permitted Use
ScopeBrandEye provides social listening, sentiment analysis, risk scoring, and audience intelligence tools through a multi-tenant cloud application. You may use BrandEye solely for lawful brand intelligence, market research, crisis monitoring, and PR management in accordance with all applicable international data regulations.
Authorized accounts are granted a non-exclusive, non-transferable, revocable subscription to access the web application, executive reporting dashboards, export pipelines, and alerting endpoints in accordance with their purchased subscription tier.
2. Public Data Ingestion Protocols
ComplianceBrandEye ingests publicly available content across supported platforms (Reddit, YouTube, Instagram, LinkedIn, Bluesky, RSS, and others as integrated). You agree not to use the platform to deanonymize individuals, harvest private personal contact information, or violate individual platform developer policies.
- Zero private message crawling or protected account surveillance.
- All platform queries conform to official developer rate limits and fair-use guidelines.
- Real-time token caching expires according to individual social network retention policies.
3. Service Availability & Enterprise SLAs
99.9% UptimeFor Pro and Enterprise subscriptions, BrandEye provides guaranteed service availability standards and critical response workflows:
We target 99.9% monthly service uptime for core ingestion and alerting endpoints, backed by redundant cloud availability zones.
Enterprise accounts receive priority technical response within 4 business hours for severity-1 data synchronization incidents.
Non-emergency upgrades occur during designated off-peak maintenance windows with at least 48 hours advance dashboard notice.
4. Customer IP & Model Isolation
100% OwnedYou retain all ownership rights to your configured search queries, custom tags, private reporting templates, and tenant-specific settings. BrandEye will never sell your query history or use your private workspace data to train shared public foundation models without explicit contractual consent.
Customer keywords, exported slide decks, and analyst annotations are processed via isolated inference containers. Your proprietary intelligence never bleeds into public LLM training corpora.
5. Acceptable Use Restrictions
Strict GovernanceUsers shall not: (a) attempt to reverse engineer or extract underlying AI system prompts; (b) launch automated scraping or denial-of-service attacks against BrandEye infrastructure; or (c) use BrandEye intelligence for unlawful harassment or targeted discrimination.
6. Subscriptions, Billing & Cancellations
CommercialSubscriptions are billed on a recurring monthly or annual basis via enterprise invoice or secure payment processing. Subscription fees are non-refundable except where explicitly stipulated under an active enterprise SLA credit agreement.
You may cancel your plan at any time through your account portal. Upon cancellation, your workspace retains active read and export access until the end of the current billing cycle, followed by a 30-day graceful data retrieval window before permanent decommission.
7. Warranties & Limitation of Liability
DisclaimerBrandEye provides algorithmic sentiment classification and contextual summaries for informational intelligence purposes. BrandEye does not guarantee that third-party public discussions are error-free or that public sentiment will directly translate to specific commercial or market outcomes.
In no event shall BrandEye's aggregate liability exceed the total subscription fees paid by Customer in the twelve (12) months preceding the incident giving rise to liability.
8. Governing Law & Enterprise MSAs
JurisdictionThese Terms shall be governed by and construed in accordance with applicable enterprise commercial law. For customized Master Services Agreements, tailored data processing agreements (DPAs), or bespoke security schedules, please coordinate directly with our legal operations desk.
